Terms of service

prompt4hire is an online marketplace that connects people offering Ai-related services and creative work with people looking to buy them. prompt4hire provides the venue — listings, search, profiles, and messaging — but is not a party to any agreement between members. Contracts, deliverables, and payment are agreed and settled directly between the members involved.

You need an account to post listings, message members, or save items. You can register with an email address and password or through Google sign-in. You must provide accurate information, keep your credentials confidential, and be at least [Owner to confirm: minimum age, e.g. 18] to use the service. You are responsible for activity under your account.

Members can publish service offers, work requests, professional profiles, photos, and messages (“content”). You retain ownership of your content. By posting it you grant prompt4hire a non-exclusive, worldwide licence to host, display, and distribute it as needed to operate and promote the marketplace.

You must not post content that:

• is illegal, fraudulent, misleading, or deceptive;
• infringes anyone's intellectual property or privacy rights;
• is hateful, harassing, sexually explicit, or promotes violence;
• advertises services you are not able or permitted to provide;
• contains spam, malware, or attempts to harvest other members' data;
• attempts to circumvent reporting, moderation, or access controls.

prompt4hire operates as an online platform intended to connect users with independent service providers and professionals. Except where expressly stated otherwise, prompt4hire does not provide, perform, supervise, guarantee, or assume responsibility for services advertised or offered by users.

Service providers operate independently and are solely responsible for their services, qualifications, representations, pricing, performance, deliverables, communications, contractual obligations, and compliance with applicable laws.

prompt4hire is not a party to agreements entered into directly between users and service providers unless expressly agreed in writing.

Users are solely responsible for evaluating other users, verifying credentials and qualifications, assessing suitability, negotiating terms, and deciding whether to engage in any transaction or professional relationship.

prompt4hire does not guarantee the identity, honesty, reliability, competence, financial standing, conduct, or performance of any user or service provider. Any verification or moderation features provided by the Platform do not constitute a guarantee of trustworthiness or future performance.

To the maximum extent permitted by law, prompt4hire disclaims responsibility for disputes, misconduct, negligence, misrepresentations, omissions, contractual breaches, injuries, property damage, losses, or other harm arising from interactions or transactions between users.

The Platform is provided on an “as is” and “as available” basis to the maximum extent permitted by law.

prompt4hire does not warrant that the Platform will be uninterrupted, secure, error-free, continuously available, compatible with every device, or free from harmful components. We do not guarantee the accuracy, completeness, timeliness, legality, or reliability of user-generated content, listings, recommendations, search results, or information made available through the Platform.

We may modify, suspend, restrict, or discontinue any feature or part of the Platform where reasonably necessary for operational, security, business, or legal reasons.

To the maximum extent permitted by applicable law, prompt4hire and its owners, operators, affiliates, contractors, service providers, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, anticipated savings, business opportunities, reputation, goodwill, data, or business interruption arising from or relating to the Platform, these Terms, or interactions between users.

This exclusion applies regardless of the legal theory asserted, including contract, tort, negligence, or otherwise, to the extent such exclusions are legally enforceable.

To the maximum extent permitted by applicable law, the aggregate liability of prompt4hire and its owners, operators, affiliates, contractors, service providers, and representatives for all claims arising out of or relating to the Platform or these Terms will not exceed the total amount actually paid by the claimant directly to prompt4hire for use of the Platform during the twelve (12) months immediately preceding the event giving rise to the claim.

If the claimant paid no amount directly to prompt4hire during that period, the proposed contractual limit is zero dollars, but only to the extent a zero-dollar limit is valid and enforceable under applicable law.

This limitation applies collectively to all claims, rather than separately to each claim, and applies to the maximum extent permitted by law.

Nothing in this section excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including any non-waivable consumer rights or other mandatory legal protections.

Users are responsible for their decisions to contact, hire, engage, pay, or otherwise interact with other users through the Platform.

To the maximum extent permitted by law, users assume the risks associated with independent transactions, third-party services, user-submitted information, online communications, and dealings with other users.

Users are encouraged to conduct appropriate due diligence, establish written agreements where suitable, independently verify important claims, and use reasonable precautions when sharing personal information or arranging services.

Nothing in this section removes rights or remedies that cannot legally be waived.

The Platform may rely on or link to third-party hosting, payment, analytics, authentication, communications, mapping, artificial intelligence, or other services.

To the maximum extent permitted by law, prompt4hire is not responsible for independent third-party products, services, outages, policies, content, security incidents, or acts and omissions beyond its legally attributable responsibility. Third-party services may be subject to their own terms and privacy policies.

This section does not excuse prompt4hire from obligations that applicable law imposes directly on the Platform operator.

To the extent permitted by applicable law, users agree to defend, indemnify, and hold harmless prompt4hire and its owners, operators, affiliates, contractors, and representatives from third-party claims, damages, liabilities, reasonable legal expenses, and costs arising out of or relating to:

• The user's breach of these Terms.
• Content, listings, advertisements, or representations submitted by the user.
• Services offered, advertised, or performed by the user.
• The user's violation of applicable law or another person's rights.
• Agreements, transactions, disputes, or interactions between the user and another user.
• The user's fraud, wilful misconduct, or negligent acts or omissions.

This obligation applies only to the extent permitted by law and does not require a user to indemnify a party for liability that cannot legally be shifted to that user.

Nothing in these Terms excludes, restricts, or modifies any right, remedy, duty, or liability that cannot lawfully be excluded, restricted, or modified under applicable law.

Where any provision is unenforceable, it will be interpreted or limited to the minimum extent necessary to make it enforceable, where permitted. The remaining provisions will continue in effect to the extent legally permissible.

Members can report listings and profiles that break these terms. Authorised moderators review reports and may remove content, pause or remove listings, and suspend or terminate accounts at their discretion. We may also remove content without a report where it clearly breaks these terms.

You can stop using prompt4hire at any time and request account deletion. We may suspend or terminate accounts that break these terms or create risk for other members.
